FlashMath Education Terms of Service (US)

These Education Terms of Service ("Education Terms") are a binding agreement between the subscribing educator, school, or district ("School," "you," or "your") and FlashMath LLC ("FlashMath," "we," "us," or "our") governing your access to and use of FlashMath education plans, including FlashClass and FlashEdu (collectively, the "Education Services").
By purchasing or activating an education plan, you agree to these Education Terms. If you do not agree, do not use the Education Services.
These Education Terms supplement and, where they conflict with respect to the Education Services, take precedence over the general Terms and Conditions.
1. Scope
- These Education Terms apply to FlashClass and FlashEdu plans used in the United States for educational purposes.
- Our Education Privacy Policy explains how we collect, use, and disclose personal information in the context of education plans.
- For general consumer accounts and plans (FlashMath+, FlashFamily), the general Terms and Conditions and Privacy Policy apply.
2. Education Plans
2.1 FlashClass
- FlashClass is a recurring subscription for individual educators, tutors, and small groups.
- FlashClass includes a specified number of student accounts (currently 15). Additional students may be added at a per-student fee.
- Monthly and annual billing options are available.
- We may offer introductory or Year 1 promotional pricing for annual FlashClass subscriptions. The promotional price and the standard renewal price will both be disclosed before purchase.
2.2 FlashEdu
- FlashEdu is a flat-rate school or district license.
- FlashEdu pricing is based on custom quotes. Contact us for pricing.
- FlashEdu may be governed by an additional institutional agreement where applicable.
3. Roles and Responsibilities
3.1 School Responsibilities
- You are responsible for obtaining all consents required by law before allowing students to access the Education Services, including consent under the Children's Online Privacy Protection Act (COPPA) and the Family Educational Rights and Privacy Act (FERPA) where applicable.
- Where COPPA applies, the School may provide consent on behalf of parents for the collection of student personal information for educational purposes, as authorized under the FTC's COPPA Rule.
- You represent that you have the authority to agree to these Education Terms on behalf of the School, and that you have obtained or will obtain all required consents before creating or authorizing student accounts.
- You are responsible for ensuring appropriate use of the Education Services by your students and staff.
- You must promptly notify us of any changes to student enrollments, including students who should no longer have access.
3.2 FlashMath Responsibilities
- We will provide the Education Services as described and will not use student personal information for purposes materially different from providing and improving the Education Services.
- We will not use student personal information for targeted advertising or create advertising profiles based on student data.
- We will maintain reasonable security measures to protect student data.
- We will cooperate with the School to respond to parent requests regarding student data, subject to verification.
4. Student Accounts
- Student accounts created under an education plan are managed by the subscribing educator or school administrator.
- Students under 13 may access the Education Services through school-managed accounts where the School has provided consent as described in Section 3.1.
- Students under 13 may not create standalone accounts. Student account creation is managed by the educator or school administrator.
- Student accounts may have limited features compared to consumer accounts, as determined by plan features and educator settings.
- Student data remains associated with the School's education plan for the duration of the subscription.
5. Data Use Restrictions
- Student personal information collected through education plans will be used solely to provide, maintain, support, and improve the Education Services, and for legitimate educational purposes.
- We will not sell student personal information.
- We will not use student personal information for targeted advertising.
- We will not use student data to create advertising profiles.
- De-identified or aggregated data that cannot reasonably identify individual students may be used for product improvement, research, and analytics.
6. FERPA Compliance
- To the extent student data constitutes "education records" under FERPA, FlashMath acts as a "school official" with a "legitimate educational interest" under the School's direct control.
- FlashMath will not disclose student education records to third parties except as permitted by FERPA, directed by the School, or required by law.
- The School retains ownership and control of student education records.
- FlashMath will cooperate with the School to enable the School to meet its FERPA obligations, including responding to parent requests for access to or amendment of education records.
7. COPPA Compliance
- For students under 13, the School acts as the parent's agent for purposes of providing consent under COPPA, as authorized by the FTC's COPPA Rule for educational contexts.
- We will collect only the personal information reasonably necessary to provide the Education Services to students under 13.
- Parents retain the right to review their child's personal information, request deletion, and refuse further collection. The School will facilitate such requests, and FlashMath will cooperate in processing them.
- We will not condition a student's participation on the collection of more personal information than is reasonably necessary.
8. Subscription and Billing
8.1 FlashClass Billing
- FlashClass subscriptions are billed on a recurring basis at the rate disclosed at purchase.
- Unless canceled, subscriptions renew automatically at the end of each billing period.
- Where a promotional or introductory rate applies (such as a Year 1 annual discount), renewal after the promotional period is at the standard rate disclosed at purchase.
- Additional students beyond the included allotment are billed at the per-student rate disclosed at purchase.
8.2 FlashEdu Billing
FlashEdu billing is based on the terms of the institutional quote or agreement.
8.3 Cancellation
- You may cancel at any time through account settings or by contacting us.
- Cancellation stops future renewals. Access continues through the end of the current paid period.
- Upon cancellation or expiration, student data may be retained for a reasonable period to allow data export, after which it will be deleted in accordance with our data retention practices.
9. Data Export and Deletion
- Schools may request export of student data at any time during an active subscription.
- Upon termination of an education plan, we will delete student personal information within a reasonable period (typically 90 days), unless retention is required by law or requested by the School.
- De-identified or aggregated data may be retained.
10. Security
- We implement reasonable administrative, technical, and organizational safeguards designed to protect student data.
- In the event of a data breach affecting student data, we will notify the School within a reasonable timeframe as required by applicable law.
- We will cooperate with the School in investigating and responding to any security incident.
11. Disclaimers and Limitation of Liability
- The disclaimers and limitation of liability provisions in the general Terms and Conditions apply to the Education Services, except as modified by these Education Terms.
- We do not guarantee specific educational outcomes.
12. Changes to These Education Terms
- We may update these Education Terms from time to time.
- If we make material changes, we will provide notice by reasonable means.
- Continued use of the Education Services after the effective date of changes constitutes acceptance, except where additional consent is required by law.
