FlashMath Education Privacy Policy (US)

FlashMath LLC ("FlashMath," "we," "us," or "our") provides this Education Privacy Policy to explain how we collect, use, disclose, and retain personal information when students and educators use FlashMath education plans, including FlashClass and FlashEdu (collectively, the "Education Services").
This Education Privacy Policy is intended for schools, educators, parents, and students in the United States using the Education Services.
For consumer accounts and plans (FlashMath+, FlashFamily), the general Privacy Policy applies.
1. Scope
This Education Privacy Policy applies to personal information collected through education plan accounts, including:
- Student accounts created or managed by educators or school administrators.
- Educator accounts associated with FlashClass or FlashEdu plans.
- Data generated through student use of the Education Services.
2. Personal Information We Collect
2.1 Student Information
We collect the following personal information about students through the Education Services:
- First name, last name, or student identifier (as provided by the educator or school)
- Username and account credentials metadata
- Grade level or age category (where provided)
- Classroom or group assignment
- Practice session activity and results
- Match history, ratings, and statistics
- Progression metrics (XP, levels, achievements)
- Virtual currency and virtual item inventory activity
2.2 Educator and Administrator Information
- Name and email address
- School or organization name
- Classroom and roster management data
- Account credentials metadata
- Subscription and billing information
- Support communications
2.3 Device and Technical Information
- IP address
- Device type, browser, operating system
- Log files, timestamps, and crash/error diagnostics
- In-app usage events and interactions
3. How We Use Student Personal Information
We use student personal information solely for the following purposes:
- Providing and maintaining the Education Services, including gameplay, practice, and progress tracking.
- Enabling educator features such as classroom management, progress reports, and assignment tools.
- Enforcing platform rules, detecting abuse, and maintaining security.
- Providing technical support.
- Improving and developing the Education Services (using de-identified or aggregated data where feasible).
We do not use student personal information for:
- Targeted advertising or behavioral advertising.
- Creating advertising profiles.
- Selling to third parties.
- Any purpose materially different from providing and improving the Education Services.
4. How We Disclose Student Personal Information
We may disclose student personal information only in the following circumstances:
- To the School: Educators and administrators can access student data within their Education Services account (progress reports, activity data, roster information).
- Service Providers: To vendors performing services on our behalf that are necessary to operate the Education Services (hosting, infrastructure, security). These providers are contractually obligated to protect student data and use it only for the services they provide to us.
- Legal/Compliance: When required by law, court order, subpoena, or lawful process, or to protect rights, safety, and security.
- Corporate Transactions: In connection with a merger, acquisition, or sale of assets, subject to the acquirer agreeing to be bound by these privacy commitments.
- With School Direction: Where the School directs or authorizes disclosure.
5. COPPA Compliance
- For students under 13, the School provides consent on behalf of parents for the collection of student personal information for educational purposes, as authorized under the FTC's COPPA Rule.
- We collect only the personal information reasonably necessary to provide the Education Services.
- Parents retain the right to:
- Review their child's personal information (through the School or by contacting us).
- Request deletion of their child's personal information.
- Refuse further collection of their child's personal information.
- To exercise these rights, parents should contact their child's school or educator first. The School will facilitate the request, and FlashMath will cooperate in processing it. Parents may also contact us directly at education@flashmath.io.
- We will not condition a student's participation on the collection of more personal information than is reasonably necessary.
6. FERPA Compliance
- To the extent student data constitutes "education records" under FERPA, FlashMath acts as a "school official" with a "legitimate educational interest" under the School's direct control.
- We will not disclose student education records to third parties except as permitted by FERPA, directed by the School, or required by law.
- The School retains ownership and control of student education records.
- We will cooperate with the School to enable the School to meet its FERPA obligations.
7. Data Retention
- Student personal information is retained for the duration of the School's active education plan subscription.
- Upon termination or expiration of an education plan, we will delete student personal information within a reasonable period (typically 90 days), unless retention is required by law or the School requests extended retention for data export purposes.
- De-identified or aggregated data may be retained and used for product improvement and research.
- Transaction and tax-relevant records are retained as required for accounting and legal purposes.
8. Data Security
- We implement reasonable administrative, technical, and organizational safeguards designed to protect student data, including encryption in transit (TLS) and at rest where feasible, access controls, and regular security assessments.
- In the event of a data breach affecting student data, we will notify the School within a reasonable timeframe as required by applicable law.
- No system is completely secure, and we cannot guarantee absolute security.
9. Data Export
- Schools may request export of student data at any time during an active subscription by contacting education@flashmath.io.
- Data export will be provided in a commonly used, machine-readable format.
10. Third-Party Services
- The Education Services may integrate with school identity providers (Google, Microsoft, Clever) for single sign-on. These integrations are governed by the School's agreements with those providers.
- We do not embed third-party advertising or tracking technologies in the Education Services.
11. Parent and Student Rights
11.1 Parent Rights
Parents of students using the Education Services have the following rights:
- Right to review their child's personal information.
- Right to request correction of inaccurate personal information.
- Right to request deletion of their child's personal information.
- Right to refuse further collection of their child's personal information.
11.2 How to Exercise Rights
- Parents should first contact their child's school or educator.
- Parents may also contact FlashMath directly at education@flashmath.io.
- We may verify identity and authorization before processing requests.
12. Changes to This Education Privacy Policy
- We may update this Education Privacy Policy from time to time.
- If we make material changes, we will provide notice to subscribing schools by reasonable means.
- The "Effective Date" and "Last Updated" fields indicate when updates apply.
